1. Acceptance of terms

By creating an account or using GetWella, you agree to these Terms of Service. If you do not agree, please do not use the service. We may update these terms from time to time, and continued use of GetWella after changes constitutes acceptance of the updated terms.

2. Description of service

GetWella is a health tracking and AI-powered insights platform. It allows you to log daily health data (sleep, energy, stress, weight, meals, and more), track fasting sessions, view trends and patterns, and receive personalised AI-generated health insights based on your data.

GetWella is designed for informational and wellness purposes. It helps you understand patterns in your own health data. It does not provide medical advice, diagnosis, or treatment.

3. Eligibility

You must be at least 18 years old to use GetWella. By creating an account, you confirm that you are at least 18 years of age and that you agree to these Terms of Service.

4. Your account

You are responsible for maintaining the security of your account credentials. Each person should maintain only one account. You agree to provide accurate information when creating your account and to keep your login details confidential. You are responsible for all activity that occurs under your account.

5. Subscription and billing

• Free tier: Core features are available at no cost and will remain free. This includes daily check-ins, fasting timer, 7-day charts, and CSV data export.
• Premium subscription: $9.99 per month or $99.99 per year. Premium unlocks unlimited AI questions, extended chart history, and advanced pattern detection.
• Free trial: New users receive a 14-day free trial of Premium features. No credit card is required to start the trial.
• Cancellation: You can cancel your subscription at any time from your Settings page. Your Premium access continues until the end of the current billing period.
• Refund policy: If you are not satisfied within the first 30 days of a paid subscription, email us at support@getwella.com and we will issue a full refund. No questions asked.

Payments are processed securely by Stripe. GetWella does not store your credit card details.

6. Health disclaimer

The AI-generated insights are based on patterns in your self-reported data and general health knowledge. They are not a substitute for professional medical advice. If you have concerns about your health, please consult a doctor or other qualified healthcare provider.

7. Acceptable use

You agree not to:

• Use the service for any unlawful purpose.
• Attempt to access other users' accounts or data.
• Scrape, crawl, or automatically extract data from the platform.
• Impersonate another person or misrepresent your identity.
• Interfere with or disrupt the service or its infrastructure.
• Use the service to distribute spam, malware, or harmful content.

8. Data and privacy

Your privacy is important to us. Please refer to our Privacy Policy for details on how we collect, use, store, and protect your personal data. By using GetWella, you consent to the data practices described in the Privacy Policy.

9. Intellectual property

The GetWella platform, including its design, code, AI models, branding, and content, is the intellectual property of GetWella. You may not copy, reproduce, or redistribute any part of the platform without written permission.

Your data belongs to you. You retain full ownership of all health data, check-in entries, and notes you enter into GetWella. You can export your data at any time using the CSV export feature, which is free and always will be.

10. Limitation of liability

GetWella is provided “as is” without warranties of any kind, either express or implied. We do not guarantee that the service will be uninterrupted, error-free, or that AI-generated insights will be accurate or complete.

To the maximum extent permitted by law, GetWella shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the service. Our total liability shall not exceed the amount you paid for the service in the 12 months preceding the claim.

11. Termination

You may delete your account at any time. Upon deletion, your personal data will be permanently removed within 30 days, as described in our Privacy Policy.

We reserve the right to suspend or terminate accounts that violate these Terms of Service or engage in abusive behaviour. We will notify you before taking such action, except in cases of serious or repeated violations.

12. Governing law

These Terms of Service are governed by the laws of the Federal Republic of Germany. Any disputes arising from these terms or your use of GetWella shall be subject to the jurisdiction of the courts in Berlin, Germany. For EU consumers, mandatory consumer protection provisions of your country of residence may also apply.
